Terms of Service

1. Acceptance of Terms

By accessing or using DisplayGateGuard and the DisplayGG self-service tool (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Nature of the Service

DisplayGateGuard provides AI-powered analysis of advertising placement lists to assist advertisers in identifying potentially low-quality, brand-unsafe, or Made-For-Advertising (MFA) domains. The Service produces risk scores, category labels, and recommendations based on automated analysis of domain data.

The output of the Service is informational only. It is intended to support your decision-making process, not to replace it.

3. No Warranty on Analysis Results

The scores, labels, classifications, and recommendations produced by the Service are generated by automated systems and AI models. They may contain errors, omissions, or inaccuracies. We do not warrant that:

  • any domain score is accurate, complete, or current;
  • the Service will identify all problematic placements in your list;
  • acting on our output will improve campaign performance or prevent brand harm;
  • domains classified as low-risk are suitable for your specific brand or audience.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

4. Limitation of Liability

To the maximum extent permitted by applicable law, DisplayGateGuard, its operators, and its affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service or reliance on its output, including but not limited to:

  • advertising spend on placements that the Service failed to flag;
  • campaign performance outcomes following implementation of our recommendations;
  • brand or reputational harm resulting from placements not identified by the Service;
  • decisions made based on inaccurate or incomplete analysis results;
  • any loss of revenue, profit, data, or business opportunity.

This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

In jurisdictions that do not allow the exclusion or limitation of incidental or consequential damages, our liability is limited to the maximum extent permitted by law.

5. Your Responsibility

You are solely responsible for all advertising decisions, campaign configurations, and placement exclusions applied to your Google Ads account or any other platform. The Service does not make changes to your accounts directly. All actions taken based on our output are taken at your own discretion and risk.

You are responsible for ensuring that your use of placement exclusion lists complies with Google Ads policies, platform terms, and any applicable laws or regulations.

6. Data You Upload

When you upload a placement report, you confirm that you have the right to share that data with us. We process uploaded placement lists solely to provide the analysis service. We do not sell, share, or use your placement data for any purpose other than providing the Service to you.

7. Service Availability

We do not guarantee uninterrupted or error-free operation of the Service. We may modify, suspend, or discontinue any part of the Service at any time without notice.

8. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. The date at the top of this page indicates when the Terms were last updated.

9. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from your use of the Service shall be subject to the exclusive jurisdiction of the competent courts in the operator's place of residence.
